Woman charged with domestic assault
FAIRMONT – A 44-year-old woman, Diana Lynn Buehler, faces felony third-degree assault and domestic assault by strangulation charges.
According to information from the Fairmont Police Department:
Around 8:45 p.m. Aug. 14, police were called to a report of a couple fighting, and told the woman – identified as Buehler – stabbed the man with her keys.
Both Buehler and the man involved were charged last month with assault for an altercation with each other, and no-contact orders for both had been in place, but were recently dropped. The man had been too afraid to contact police about the assault because he believed he would go back to jail.
Police observed the man’s face was bloodied and there was a cut on the left side of his face. A witness told police Buehler punched the man several times and stabbed him in the face with a key. The cut appeared as if it could have been made with a key, and the man reported he could feel the puncture wound inside of his mouth.
The man told police Buehler had kicked in his apartment door and took his wallet. He then contacted the witness in an attempt to avoid any problems with Buehler. They later found the man’s wallet, but his EBT card was missing, and the man went online to cancel the card. The man said Buehler later came back and attacked him, and that he sat on his hands so Buehler couldn’t say that he had hit her.
The witness reported seeing Buehler hit the man several times in the head, and at one point had her hands around his neck and was choking him, and she punched the man with a set of keys between her fist.
Police attempted to contact Buehler at her apartment, but she would not answer the door and they heard the security chain go into place. The maintenance man unlocked Buehler’s door for police and police commanded Buehler to remove the security chain. Once she complied, she was placed under arrest. When police attempted to question her, Buehler said she wanted an attorney.
Third-degree assault carries a maximum penalty of five years in prison and a $10,000 fine. Domestic assault by strangulation carries a maximum penalty of three years in prison and a $5,000 fine.
Buehler also faces a gross misdemeanor charge of domestic assault as a subsequential violation; maximum penalty of one year in jail and a $3,000 fine.
