Local man faces criminal sex charge
FAIRMONT – An 18-year-old Fairmont man faces charges of criminal sexual conduct after allegedly having sex with a person between the ages of 13 and 15.
According to information from the Fairmont Police Department:
On July 21, a man reported to police his concerns regarding an underage young teen suspected of having a sexual relationship with Cessario Andres Lerma. The teen was brought in for questioning and admitted there was texting, and that the teen had gone over to Lerma’s residence three times that month. The teen later admitted that during one of those visits the teen had intercourse with Lerma.
Lerma was located and interviewed by police. He said he and the teen had texted and when the teen came over, they just talked on the porch. Lerman also knew the teen was underage. Later in the interview, Lerma admitted to having sex with the teen.
Lerma has other pending criminal sexual conduct charges in Martin County. One of the conditions of his release is not to have contact with anyone under the age of consent.
The third-degree criminal sexual conduct charge carries a maximum penalty of five years in prison and a $30,000 fine.
